Born a woman, Beatie Thomas, 34, who had had his breasts surgically removed and legally changed his gender from female to male, leaped to prominence around the world in April,2008 when the wispy bearded man revealed he was pregnant.
Although Beatie was living as a man when he married Nancy in Honolulu in 2003. The couple later moved to Arizona, a more conservative state, where Nancy was unable to have children. Because Thomas retained his female reproductive organs while undergoing the gender change, he gave birth to three children conceived with donated sperm. He became known as the “Pregnant Man” when he first became pregnant in 2008.
“I actually opted not to do anything to my reproductive organs because I wanted to have a child one day. I see pregnancy as a process, and it doesn’t define who I am,” Beatie told Oprah Winfrey in April,2008.
“I feel it’s not a male or female desire to have a child. It’s a human need. I’m a person and I have the right to have a biological child,” he said.
Beatie was impregnated with sperm from a donor. His wife, Nancy, inseminated him at home with a device she said was like a syringe without the needle. They bought it from a veterinarian and it is typically used to feed birds.
“Imagine what this is doing to my children,” Beatie said. “In time, they are going to look back and see that a court said that’s not your daddy. I’m sorry, that’s who I am. I am my children’s father.”
In his ruling, Judge Gerlach said that there is not enough proof that Beatie was legally a man when he married his wife, pointing out that he had stopped hormone treatments in order to get pregnant.
“Parties have failed to show that the word ‘man’ in the state constitution means anything different from its plain, ordinary meaning, which by any generally accepted definition or reputable dictionary excludes people capable of giving birth,” the judge wrote.
